Measure App gives you estimates, not certified measurements. It is a convenient everyday tool, not a calibrated instrument. Do not rely on it where an inaccurate figure could cause injury, damage, financial loss or a legal consequence — check those with a physical tape, rule or professional instrument.
These terms form an agreement between you and Arron Mecwan (“we”, “us”) governing your use of the Measure App iOS application (the “app”). By downloading or using the app you accept these terms. If you do not accept them, please do not use the app.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, in line with the App Store Terms of Service and Apple's Licensed Application End User Licence Agreement. This is a licence to use the app, not a sale of it. We keep all rights not expressly granted to you here.
This is the most important section of these terms.
The app estimates physical quantities using your device's camera, motion sensors and screen. Every one of those methods has real limits:
Do not use the app as the sole basis for any decision where an inaccurate measurement could cause harm or loss. That includes, without limitation: construction, structural, engineering or safety work; medical, clinical or diagnostic purposes; navigation; legal, survey, valuation or regulatory filings; and any cutting, ordering or manufacturing that cannot be undone. Always verify with an appropriate calibrated instrument.
You are responsible for deciding whether the app is suitable for what you are doing, and for checking any figure that matters.
Some features require a Measure Pro subscription. All subscriptions are sold and processed by Apple through your App Store account — we never handle your payment details.
Current prices and terms are shown in the app before you confirm any purchase.
Please use the app lawfully and reasonably. You agree not to reverse-engineer, decompile or disassemble the app except where that restriction is prohibited by law; not to copy, resell, sublicense or redistribute it; not to remove or obscure any proprietary notice; not to circumvent the subscription mechanism or otherwise obtain paid features without paying for them; and not to use the app to infringe anyone's rights, including by photographing people or private property where you have no right to do so.
Measurements, photographs, projects and floor plans you create with the app are yours. They are stored on your device and we never receive them, so we claim no rights over them and take no responsibility for backing them up. Exporting or sharing anything you create is your decision, and you are responsible for what you choose to share and with whom.
The app, its source code, design, interface, icon and name are owned by us and protected by copyright and other laws. These terms do not transfer any ownership or grant you any right to use our name or branding.
We may update, change or discontinue the app or any of its features at any time. New versions may add, alter or remove functionality. We support recent versions of iOS and features may depend on device hardware — the AR tools in particular require a device that supports ARKit.
The app is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any measurement it produces will be accurate or fit for your purpose.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, or business, arising out of or connected with your use of the app — including any loss or damage resulting from reliance on a measurement it produced.
Our total liability to you for all claims relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim arose, or ten US dollars.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you use the app as a consumer, you keep the full benefit of any mandatory consumer protection rights under the law of your country of residence, and nothing here overrides them.
Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
We may revise these terms from time to time. The “last updated” date at the top of this page shows when they last changed. Continuing to use the app after a revision means you accept the revised terms. If you do not accept them, stop using the app and cancel any subscription.
The app is operated from the United States and made available worldwide.
Governing state to be confirmed. A US governing-law clause normally names a specific state. Once confirmed, this section will read: “These terms are governed by the laws of the State of [state] and the United States, without regard to its conflict of law rules.”
Where you use the app as a consumer outside the United States, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts where the law gives you that right.
Questions about these terms are welcome.
